This Policy has been issued by the Data Controller – Optimum Process Limited Liability Company, based in Warsaw, Poland, at Al. Jerozolimskie 181B, NIP 5213786607, KRS 0000684901, REGON 367693875 and is addressed to all users (“Users”) of our website (“Website”). This Policy may be amended and updated to reflect changes in our Personal Data Processing practices or changes in applicable law. We encourage you to review this Policy carefully and check this page regularly to verify any changes that the Controller may implement in accordance with this Policy’s provisions.

II. Processing of Users’ Personal Data

Acquisition of Personal Data: The Controller may acquire Users’ Personal Data such as: first name, last name, and registration data, including email address. Personal Data may be acquired, in particular, in the following instances:

  • When Users provide Personal Data (e.g., through email contact, telephone, forms, or any other means).
  • From acquiring Personal Data during business relations / entering into or performing a service subscription agreement with VoiceLark.com.
  • From requesting or asking Users to provide their Personal Data during visits to the Controller’s pages or using any features or resources available on or through the Website. When Users visit the Website, their devices and browsers may automatically disclose certain information (such as device type, operating system, browser type, browser settings, IP address, language settings, connection times, and other technical communication information), some of which may constitute Personal Data. No Personal Data of Users will be stored by the Controller without prior, explicit consent. However, temporary storage of log files and cookies facilitates the use of our Website. For this reason, Users are asked to consent to this on our Website. Granting consent is optional and does not affect the ability to use the Website. In some cases, without such consent, the ability to use our Website may be somewhat limited.

Processed Personal Data: Categories of Users’ Personal Data Processed by the Controller may include:

  • Personal data: first name(s), last name(s),
  • Contact data: phone number, email address,
  • Payment information: bank account number, name and surname of the bank account holder, credit card number,
  • Content of messages: messages stored on the Service solely to the extent necessary for their secure storage by the User.

Social media data processing: The Controller may use funpage-type profiles on social media platforms. Public data shared by social media users can be used for:

  • Responding to private messages directed to us,
  • Leading discussions in comments under individual posts,
  • Sharing our posts with people following our Fanpage,
  • Marketing by informing about our services and about us through posts we place on our Fanpage, including sponsored posts that are displayed to a wider audience,
  • Statistical purposes presenting data on our post views, their reach, number of interactions, and demographic data of our followers; the data presented to us by the owners of social media platforms are statistical data, but they are created based on observations of your behavior on our Fanpage.

Legal bases for Processing Personal Data: In Processing Personal Data of Users for the purposes indicated in this Policy, the Controller may rely on one or more of the following legal bases, depending on the circumstances:

  • Processing is based on the User’s prior voluntary, specific, informed, and unambiguous consent;
  • Processing is necessary for the performance of a contract to which the User is party or in order to take steps at the request of the User prior to entering into a contract;
  • Processing is necessary for compliance with a legal obligation to which the Controller is subject;
  • Processing is necessary to protect the vital interests of any natural person;
  • Processing is necessary for the purposes of the legitimate interests pursued by the Controller and does not unduly prejudice the interests or fundamental rights and freedoms of the User.

Purposes of Processing Personal Data: The purposes for which the Controller may process Personal Data of Users are as follows:

  • Administrator’s Website: running and managing our Website, presenting its content; publishing advertisements and other promotional and marketing information; communication and contacts with customers and suppliers, as well as potential employees or collaborators, through our Website.
  • Offering Users the products and services of the Controller: presenting our Website and other services; communication related to the services of the Controller.
  • Marketing communications: presenting in any way (including email, phone, text message, social media, mail, and personal contact) messages and other information that may interest Users, including distribution of newsletters and other commercial information, after obtaining Users’ consent to send information in an appropriate manner, based on generally applicable legal provisions.
  • Communication and IT operations: managing communication systems, acting for IT security purposes, and IT security audits.
  • Financial management: sales, finance, audits, and sales management.
  • Improving our products and services: identifying issues with existing products and services; planning improvements to existing products and services; and creating new products and services.

III. Disclosure of Personal Data to Third Parties

The Controller may disclose Users’ Personal Data to:

  • Administrative or judicial bodies, at their request, to report actual or suspected violations of applicable law;
  • Persons conducting audits, lawyers, PR agencies, with respect to confidentiality obligations arising from contract or imposed by law;
  • Third parties processing entrusted data on behalf of the Controller regardless of their location, in accordance with the requirements set out in this section III below;
  • Any entity appropriate for the purposes of preventing, investigating, detecting, or prosecuting criminal acts or executing criminal penalties, including securing and preventing threats to public security;
  • Any entity acquiring, in the event of the sale or transfer of any organized part of the Controller or shares in the share capital of the Controller (including in the case of reorganization, dissolution, or liquidation).

Regardless of the above, the Website may use plugins or content presented by third parties. If Users decide to use them, Personal Data of Users may be shared with third parties or social media platforms. The Controller hereby recommends familiarizing yourself with the privacy policy of the third party before using their plugins or content.

If we engage a third party to Process Personal Data of Users, in accordance with the contract for the processing of data entered into with such an entity, the Processor will be obliged to: (i) Process only the Personal Data specified in prior, written instructions of the Controller; and (ii) apply all measures to protect the confidentiality and security of Personal Data and to comply with all other applicable legal requirements.

The entity processing Personal Data of Users obtained through the Website is Optimum Process Limited Liability Company, the creator of this Website. The support service in connection with the use of the Website is provided by Optimum Process Limited Liability Company. This entity stores and processes Personal Data of Users obtained while using the Website by Users. The Processor ensures the complete security of Personal Data of Users by applying appropriate and up-to-date technical and organizational measures. The Processor may not use the provided Personal Data of Users for purposes other than those for which they were entrusted by the Controller.

IV. International Transfer of Personal Data

Currently, the Controller does not transfer and does not intend to transfer any Personal Data of Users to third countries not members of the European Union or to international organizations. Should such a need arise, this Policy will be modified, and the transfer of Personal Data of Users may only occur based on standard contractual clauses that the Controller will implement prior to making such a transfer. In such a case, Users will be entitled to request a copy of the standard contractual clauses used by the Controller, using the contact details indicated in section XII below.

V. Data Protection

The Controller informs that it has implemented appropriate technical and organizational measures to protect Personal Data, in particular including safeguards against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, unauthorized access, and other unlawful and unauthorized forms of Processing, in accordance with applicable law. The Controller is not responsible for actions or omissions of Users. Users are responsible for ensuring that all Personal Data is transmitted to the Controller in a secure manner.

VI. Data Accuracy

The Controller takes all appropriate measures to ensure that:

  • Personal Data of Users, which the Controller Processes, are accurate and, where necessary, updated; and
  • All Personal Data of Users, which the Controller Processes, and which are inaccurate (having regard to the purposes for which they are Processed) are erased or rectified without delay.

The Controller may at any time ask Users about the accuracy of the Processed Personal Data.

VII. Data Minimization

The Controller takes all appropriate measures to ensure that the scope of Personal Data of Users, which it Processes, is limited to the Personal Data adequately necessary for the purposes stated in this Policy.

VIII. Data Retention

Criteria determining the duration of the period in which the Controller stores Personal Data of Users are as follows: The Controller stores copies of Personal Data of Users in a form that permits identification only as long as necessary to achieve the purposes indicated in this Policy, unless generally applicable legal provisions require a longer period of storage of Personal Data. The Controller may, in particular, store Personal Data of Users for the entire period necessary to establish, exercise or defend legal claims.

IX. Rights of Users

In accordance with the provisions of the General Data Protection Regulation, with respect to Personal Data of Users, which are Processed by the Controller, Users are entitled to the following rights:

  • Right of access to personal data;
  • Right to rectification of personal data;
  • Right to erasure of personal data;
  • Right to restriction of processing of personal data;
  • Right to data portability;
  • Right to object to processing of personal data;
  • Right not to be subject to a decision based solely on automated processing.

If Processing of Personal Data is based on the consent expressed by Users, Users have the right to withdraw consent at any time without affecting the lawfulness of Processing based on consent before its withdrawal.

In the event of improper Processing of Personal Data, Users have the right to lodge a complaint with the national supervisory authority for data protection, i.e., the President of the Personal Data Protection Office.

The above does not affect the rights of Users arising from laws or other generally applicable legal provisions.

X. Cookies

The Administrator uses the following websites:

When a user uses the Website, data concerning the user is automatically collected. This data includes: IP address, domain name, browser type, operating system type. This data may be collected through cookies, the Google Analytics system, and may be stored in server logs.

Cookies remember the user’s preferences, which allows for enhancing the quality of services provided, improving search results and relevance of displayed information, and personalizing the website, creating website statistics.

XII. Definitions

  • Controller means the entity that decides how and for what purposes Personal Data are Processed. The Controller is responsible for compliance of processing with the applicable data protection law.
  • Personal Data means any information relating to any identified natural person or person who can be identified. Examples of Personal Data that the Controller may Process are listed in section II above.
  • Process, Processing, or Processed means any operations performed on Personal Data, whether or not by automated means, such as: collecting, recording, organizing, structuring, storing, adapting or altering, retrieving, consulting, using, disclosing by transmission, disseminating or otherwise making available, aligning or combining, restricting, erasing or destroying.
  • Processor means any person or entity that Processes Personal Data on behalf of the Controller (other than an employee of the Controller).
